ALGÉRIE/ POLITIQUE : Vers l’interdiction de manifester à Alger ?
Le débat autour de la liberté de manifester occupe de nouveau l’actualité suite aux manifestations des artistes, samedi 6 avril et celle des étudiants le 9 avril, réprimées par la police et l’interpellation de quelques activistes.
Le FFS, le PT, LADDH, Me Bouchachi et plusieurs activistes ont réagit à cette tentative d’avorter la marche du peuple. Dans des communiqués rendus public, ils dénoncent ce genre de comportement et exige le respect des droits du citoyen. Ils mettent en garde contre ces comportements répressifs.
Quelles conclusions faut-il tirer des événements de cette journée du 9 avril ? Au moment même où Abdelkader Bensalah héritait de la présidence par intérim au Palais de nations, les étudiants se faisaient matraquer au centre d’Alger par la police.
Certains diront que la police n’a fait que les dissuader de se diriger vers le Palais du gouvernement comme elle le faisait pour ceux qui tentaient de rallier la présidence chaque vendredi, mais il reste que l’usage abusif de la matraque et du canon à eau est un signe inquiétant, d’autant plus que cela survient au moment où un choix politique capital semble acté définitivement.
Avec Abdelkader Bensalah, Noureddine Bedoui et Tayeb Belaïz aux commandes, le peuple sait que le changement rêvé ne sera jamais au rendez-vous. Il l’a crié très fort dans la rue et le chef de l’armée a dit le comprendre !
Le retour à l’interdiction de manifester n’est pas écarté. Elle est l’une des cartes du pouvoir en place pour étouffer la révolte populaire.
Pour des juristes, tenir des réunions publiques est un droit et une liberté fondamentale du citoyen, garanti par la Constitution. Selon eux, «les références juridiques relatives aux réunions et aux manifestations publiques n’autorisent ni ne permettent au gouvernement ni à l’autorité administrative d’interdire l’exercice de ce droit sur une partie ou tout le territoire national». L’article 41 de la Constitution, placé sous le chapitre Droits et Libertés, stipule en effet que «les libertés d’expression, d’association et de réunion sont garanties au citoyen». Edifiant ! Sauf exception, définie clairement par des textes dûment établis, signés et publiés sur le Journal officiel de la République algérienne, tout manquement à ce principe est considéré comme une violation de la loi fondamentale.
